Can a debt collector take money from my bank account without authorization?
No. Debt collectors can ONLY withdraw funds from your bank account with YOUR permission. That permission often comes in the form of authorization for the creditor to complete automatic withdrawals from your bank account.
There are four ways to open a bank account that no creditor can touch: (1) use an exempt bank account, (2) establish a bank account in a state that prohibits garnishments, (3) open an offshore bank account, or (4) maintain a wage or government benefits account.
Collectors Taking Money from Your Wages, Bank Account, or Benefits. Debt collectors can only take money from your paycheck, bank account, or benefits—which is called garnishment—if they have already sued you and a court entered a judgment against you for the amount of money you owe.
Collection agencies can access your bank account, but only after a court judgment. A judgment, which typically follows a lawsuit, may permit a bank account or wage garnishment, meaning the collector can take money directly out of your account or from your wages to pay off your debt.
At the latest, you must notify your bank within 60 days after your bank or credit union sends your statement showing the unauthorized transaction. If you wait longer, you could have to pay the full amount of any transactions that occurred after the 60-day period and before you notify your bank.
Some sources of income are considered protected in account garnishment, including: Social Security, and other government benefits or payments. Funds received for child support or alimony (spousal support) Workers' compensation payments.
What States Prohibit Bank Garnishment? Bank garnishment is legal in all 50 states. However, four states prohibit wage garnishment for consumer debts. According to Debt.org, those states are Texas, South Carolina, Pennsylvania, and North Carolina.
A frozen bank account is a sure sign that a creditor or debt collector has obtained a court judgment against you (or your joint account holder, if you have a joint bank account). A creditor or debt collector cannot freeze your bank account unless it has a judgment.

If you did not receive a notice about the garnishment of your account, ask your bank for a copy of the garnishment order that it received. You can also contact the creditor or the court that issued the order for more information.
How do I get rid of debt collectors without paying?
You can sue the debt collector for violating the FDCPA. If you sue under the FDCPA and win, the debt collector must generally pay your attorney's fees and may also have to pay you damages. If you're having trouble with debt collection, you can submit a complaint with the CFPB.
Both state and federal laws prohibit unauthorized withdrawals from being taken from your bank account or charges made to your credit card without your express consent having first been obtained for that to occur. Some laws require this consent to have first been obtained expressly in writing.
The Fair Credit Billing Act (FCBA), which protects consumers from unfair credit card billing practices, rules that banks cannot typically seize funds deposited into a consumer's bank account to pay off their credit card.
Credit card fraud investigations generally involve banks analyzing transaction patterns and details for signs of unauthorized activity. They may collaborate with law enforcement, merchants, and cybersecurity experts if the situation requires more extensive scrutiny.
In addition to federally and state-provided assistance, things like child support payments, student loans, workers compensation and pension funds are also exempt. If you have less than two months' worth of certain benefits in your account, these are automatically exempted.
If you have a federal benefit (such as Social Security) direct deposit account, and the balance is less than two months of benefits, a bank is supposed to reject the levy except for levies for government-ordered child support or from the federal government.
A judgment creditor will review any payments previously made by the debtor. If they have written you a check in the past, the check will have their bank's information. Or, if you've made a payment to the judgment creditor (such as a prior bill), they will be able to see where the payment came from.
California is a Community Property State
As a result, it is possible for a creditor to garnish a spouse's bank account if their spouse owes a debt.
This special type of property ownership is usually only available to legally married couples. So, if you own an account jointly with another person who is not your legal spouse, that account may still be subject to full garnishment for the other person's debt.
With few exceptions, all wages are fully protected from garnishment in North Carolina, Pennsylvania, South Carolina, and Texas. Judgment creditors may seek to evade these protections by serving the wage garnishment order on the consumer's employer's office in another state.
Can creditors lock your bank account?
How Can Creditors Freeze My Bank Account? Most creditors must file a lawsuit and get a judgment against you before freezing your bank account. If the creditor wins the suit, the court issues a money judgment to the creditor. This money judgment serves as proof of the amount owed.
Ignoring or avoiding a debt collector, though, is unlikely to make the debt collector stop contacting you. They may find other ways to contact you, including filing a lawsuit. While being contacted by a debt collector might feel overwhelming, talking with them can help you get more information about the debt.
But in the meantime, if your account is frozen or might be, we recommend that you open a new bank account at a new bank where you don't owe any money. Notify your employer to deposit your paycheck into this new account. Move any money from your old account to your new account.
The 609 dispute letter is often referred to as the “legal loophole”, or the “credit repair secret' and can be useful in different situations. Apart from correcting your credit report, the 609 letter could be what you need to respond to a debt collection lawsuit.
As a precaution against scams, don't give a debt collector any personal information besides your name. Ask for the debt collector's contact information and the details about the debt. Call the debt collector back after you've verified both the debt and the debt collector, and once you have an action plan ready.
